Before me came in person ______________(“Deponent”), who, having been duly sworn, on oath says as follows:
1. That Deponent is ___________ of ____________ (“Owner”) and is familiar with the affairs of Owner, particularly relative to the property described herein.
2. That Owner is the owner of the real property described on “Exhibit A” attached hereto and made a part hereof.
3. That no broker’s services other than _____________ have been engaged by Owner with regard to the management, sale, purchase, lease, option or other conveyance of any interest in said property and that no notices of lien for any such services have been received by Owner.
4. That the Owner is the only person or party that is in possession of said property or that has any right or claim to be in possession of said property.
5. That Owner is this day conveying said property in a bona fide sale or to secure the repayment of a loan.
6. That there is no outstanding indebtedness for equipment, appliances or other fixtures attached to said property.
7. That the lines and corners of said property are clearly marked and there are no disputes concerning the location of the lines and corners.
8. That there are no pending suits, proceedings, judgments, bankruptcies, liens or executions against said Owner either in the county where said property is situated or any other county in the State of Georgia.
8. That there is not of record preliminary notice or claim lien.
9. That no improvements or repairs have been made on the above-described property during the three months immediately preceding this date, nor have there been any services of architects, surveyors or engineers incurred in connection with said property, or, in the event that there have been any such improvements, repairs or services, that the same have been fully completed and the agreed price or reasonable value of the labor, services and materials therefor has been fully paid.
10. That there are no outstanding bills for water, sewer or sanitation owning against said property.
